چکیده
حقوق بینالملل محیطزیست و حقوق بین الملل سرمایهگذاری در اهداف با هم متعارضاند به این شکل که هدف سرمایه گذار منفعت فردی و هدف محیط زیست منافع جمعی است، در حالی که در عمل و اجرا با هم ارتباط تنگاتنگی دارند و در یک محیط اجرا می شوند، و نقش اساسی در جامعه امروزی بشر ایفا می کنند. به همین جهت سرمایهگذاریهای اقتصادی توسط شرکت ها در کشورهای مختلف مستلزم قانون گذاری و بعضاً قوانین محدودکننده است. یکی از این روش ها اعمال قوانین محیط زیستی است، که اغلب در سرمایه گذاری های شرکتی و نفتی با هدف جذب سرمایه گذار خارجی، نادیده گرفته میشود. بدین ترتیب این پژوهش با روش توصیفی- تحلیلی به بررسی موضوع تعهدات محیطزیستی در سرمایه گذاریها می پردازد. تحقیقات نشان میدهد که سرمایه گذاران نفتی اغلب از تعهدات محیطزیستی چشم پوشی میکنند و دولت های حاکم بر کشورهای در حال توسعه، به دلیل محدودیت های مالی و ضعف اقتصادی با هدف جذب بیشتر سرمایه گذاران انعطاف از خود نشان می دهند، که یکی از حوزه های انعطاف آن ها قوانین محیطزیستی می باشد. در حالی که با توجه به بحران های محیطزیستی کنونی دولت ها باید با وضع و اجرای قوانین و مقررات سختگیرانه و محدودکننده، نقض تعهدات محیط زیستی را به حداقل برسانند.
